The Program:

This workshop will provide you with a unique opportunity to learn about and discuss the challenges facing school boards when they are asked to exercise quasi-judicial powers.

This is one of the most important, and one of the least understood roles a board will play in the course of managing the affairs of its school district. Many school board members have unwittingly crippled their board’s ability to perform its role in this regard by being either over-eager or simply careless in carrying out these duties.

This three-hour session will be conducted in three parts. First, we will provide the historical background of America’s attempt to generate “fair” decisions by governmental decision makers. Second, we will provide you with a complete list of practical, technical rules to follow so that you can achieve a result that will, at best, keep you out of court or, at worst, enable you to win at court. And in the final segment, we will discuss situations where Nebraska school board members have actually endured the process and survived to tell about it.

When your board is under legal scrutiny, could it serve effectively as judge and jury?
